Would you kindly refer to your letter of 4 August, 1961, with which you forwarded a copy of a letter from the Abitibi Power and Paper Company setting forth certain conditions relating to the release of timber rights in connection with the Gap Filler Radar Station near Timmins, Ontario.

This Department accepts the stipulation contained in the company's letter relating to stumpage, scaling and timber cutting charges. However, it must be pointed out that this company, as well as the others with which you have dealt thus far, has not stated whether it wants the timber or not. You will recall that this point was stressed in our earlier correspondence and it is considered that it should be cleared up during these present negotiations.

In the second paragraph, sub-par (c), of the company's letter, it is stipulated that National Defence will obtain the necessary authorizations from the Ontario Department of Lands and Forests for cutting; such permits will in fact be obtained by the Defence Construction (1951) Limited contractor carrying out construction at the site.

Would you please ensure that your agents are made aware of these facts and asked to obtain a ruling on the disposal of cut timber in the negotiations being persued with Abitibi Power and Paper Company as well as other companies controlling property in which we are interested.
