MEMORANDUM

GOVERNMENT OF CANADA

TO: A Ledoux, Esq., General Manager, Real Estate,
DOT Room 400 Trafalgar Bldg - OTTAWA.

Your File No: 26-10-7

FROM: Regional Manager, Real Estate,
Department of Transport, - MONTREAL.

Our File No: NS-1050-2

SUBJECT: St Joseph, NS - Gap Filler Station - Site and
Access Road _ MESSRS JEREMIE and ANSELM COMEAU

DATE: May 17/61

Further to our covering report of the 10th instant and your letter of March 23rd last, please find enclosed herewith the originals and four (4) copies of two (2) entry permits which have been duly executed by the subject property owners:

  1. Mr Jeremie Comeau - to allow construction of the subject installation with all associated works, on his property;

  2. Mr Anselm Comeau - to allow construction of the access road with all associated works, on his property.

Inasmuch as these installations are to be implemented on good farm lands, with resulting depreciation to a barn (in one case) and to the possible destruction of a vegetable patch (in the other case) along with the possibility of the destruction of some apple trees (in both cases), it was felt that an option agreement should not be concluded with these property owners until such time as the construction project was completed. Completion of this project will enable us to assess the exact damages suffered by these property owners as a result of our construction efforts and will thereby enable us to conclude a final settlement which will not be in danger of being brought into question later by the subject property owners.

On the other hand, our Moncton Agent did ascertain that the property owners in question would be reasonable to deal with and it is therefore felt that the cost of obtaining these lands will be consistent with reasonable and fair settlements concluded elsewhere.

For your information and further action as required.

Paul Y Desjardins
for JP Adam,
Regional Manager, Real Estate.
