Property Acquisition
Gap Filler Radar Station, Timmins Ontario

As the Gap Filler site at Timmins is one of those at which construction will be completed we wish to have Transport pursue the matter of property acquisition for the site and its access road.

It has been pointed out in the memorandum at third folio hereunder that while the Province of Ontario has granted us the surface rights we require, a Mr RE Allerston holds two mining caims on the land making up the site. In the opinion of our engineers the Crown is protected by the Mining Act from physical damage caused by mining operations and they have recommended that Mr Allerston by informed that he may proceed with his programme. This approach appears the most reasonable and economical as our site measures only 1.43 acres (250 ft square) whereas the mining operator controls 80 acres in his two claims.

In the attached draft letter Transport is informed that while we are proceeding with construction of the Gap Filler site at Timmins, Ontario, it is not our intention to purchase Mr Allerston's mining claims. Five prints of our Drawing T53-1-1003-1 are being forwarded to Transport showing the location of the site and the Allerston claims. If you concur it is recommended that the letter be signed and despatched, please.

Would you please refer to your letter of 17 July, 1962, with which you forwarded a copy of one from Mr RE Allerston, the owner of mining claims in the area of Gap Filler site being constructed at Timmins, Ontario

The property acquisition phase at Timmins has been reviewed in the light of Mr Allerston's request that the Crown purchase his mining claims P-49795 and P-51016. While the site at Timmins is one of those where we intend to bring the construction to a state of completion it is felt that as our installation involves only 1.43 acres as opposed to the 80 acres covered by the two mining claims we will rely on the protection from physical damage afforded by the Mining Act and that the owner should be informed that he may proceed with his mining program. I am attaching five copies of the AFHQ Drawing T53-1-1003-1 illustrating the property making up the site which is situated in the corner of mining claim P-49795.

I would be pleased if you would inform your Toronto office of this decision so that Mr Allerston may not be held up in his preparations to develop the claims. In this regard it has been noted that the Timmins Ski Club have a License of Occupation issued by the Department of Lands and Forests to conduct their activities on the claims which Mr Allerston says are vital for his mining operations and that the department has had a forestry tower located there for some time. It is felt that our installation will not interfere in any way with mining operations.
