WORKING AGREEMENT BETWEEN
THE UNITED STATES AIR FORCE
AND
DEPARTMENT OF TRANSPORT (DOT) CANADA
FOR
UTILIZATION OF FROBISHER AIRPORT, CANADA

  1. Agreement and Parcels of Land

    1. This agreement is made between the United States Air Force, hereafter called "USAF", and the Department of Transport of Canada, hereafter called "DOT", to set forth the detailed arrangements agreed to by USAF and DOT relating to the establishment on Frobisher Airport of certain military installations by USAF, the provision of certain services by DOT to USAF, and the assumption by DOT of certain airport operating functions heretofore handled by USAF.

    2. This working agreement is made pursuant to and to supplement the following agreements between the Governments of the Unite States and Canada:

      Pinetree Agreement (Canadian Note NO 454 dated August 1, 1951 and the US Note of the dame date)

      DEW Line Agreement (Canadian Note No 306, dated May 5, 1955 and the US Note of the same date)

      Aerial Refueling Facilities Agreement (US Note No 281 and Canadian Note No 106, both datged June 20, 1958)

      This working agreement and USAF activities and facilities at Frobisher Airport shall be subject to the provisions of the above agreements, whichever may be applicable.

    3. The areas to be used by the United States and to be occupied by USAF shall consist of parcels of land described in Appendix I.

    4. The described parcels of land include all facilities existing or to be constructed therein. That area already used by USAF under the Pinetree Agreement No 454 remains under the control of the USAF.

    5. Support space required by FECO will be consolidated into buildings T98A, T51 and a portion of T98 will be reserved for their use.

    6. USAF shall have free access at all times to the parcels of land described in Appendix I and to those other facilities on the airport upon which military operations depend.

    7. All other buildings and facilities located or constructed on the described parcels of land shall be for the sole use of USAF or will be provided to DOT for operations as specified in this agreement. If any or all of the buildings become excess to the requirements of the USAF, the building(s) shall, subject to the provision of existing Government-to-Government agreements on ownership and disposal of excess US property in Canada, be turned over to DOT.

  2. Construction

    1. Construction and/or maintenance projects of minor nature shall be agreed upon and undertaken in coordination with the appropriate local authorities.

    2. Criteria for USAF construction to be at least DOT minimum standards

    3. New construction will be in accordance with the aerial refueling facilities cited above. Base master planning shall be the responsibility of DOT. Planning within the parcels of land described in Appendix I shall be the responsibility of USAF. USAF facilities shall be sited on that portion of the airport designated in Appendix I.

    4. USAF shall be granted right of way for water and power lines, access roads, waste disposal, POL pipelines, communication lines and other required rights of way on the airport that are required in development of, or support of, the USAF mission.

  3. Administration of Facilities

    1. USAF requirements that cannot be met within the allocated areas and their contained facilities, will be accorded due priority by DOT during the assignment or reassignment of facilities.

    2. Buildings required for joint use, excluding the areas described in Appendix I, shall be allocated and administered by DOT. DOT shall give due consideration to the need and requirements of USAF or its contractors.

  4. Base Administration, Defence and Security

    1. DOT will be responsible for general administration of the airport area.

    2. The appropriate Canadian authorities will continue to be responsible for maintenance of law and order within the airport area. Command and control of US personnel will continue to be vested in USAF. Appropriate and adquate security measures for internal security within the parcels of land described in Appendix I will be taken by USAF in accordance with paragraph 10 of the Visiting Forces (North Atlantic Treaty) Act of June 1951. This paragraph is quoted for reference by the using agencies.

      "Chapter 284, paragraph 10. (a) Regularly constituted military units or formations of a force shall have the right to police any camp, establishments or other premises which they occupy as the result of an agreement with the receiving State. The military police of the force may take all appropriate measures to ensure the maintenance of order and security on such premises.

      (b)Outside of these premises, such military police shall be employed only subject to arrangements with the authorities of the receiving State and in liaison with those authorities, and insofar as such employment is necessary to maintain discipline and order among the members of the force".

  5. DOT Responsibility for Accomplishing the following for USAF

    1. General administration within the airport area.

    2. Operation of or provision for the following essential services:

      1. Communications and Aids to Navigation as covered in Appendix II. Any changes in these or future circuits involving USAF interests shall be negotiated with USAF. Changes with other items shall be negotiated directly between DOT and the agency involved.

      2. Dependent forecast surface observations office and rawinsonde station.

      3. Meeting and servicing of all US Military aircraft with water alcohol, thrust augmentation fluid, water, and deicing fluid until such time as USAF aerial refueling facilities become operational.

      4. Maintenance of roads, paved area, runways, areas adjacent to runways, taxiways, ramps and runup buttons including USAF parcels of land as defined in Appendix I.

      5. Maintenance of all buildings and facilities on the airport except of the Baffin Island Air Station (AC&W) site.

      6. Snow removal and snow control of all areas, except Baffin Island Air Station, but including access roads thereto and the taxiways, ramps, roads and other areas where snow removal and/or control is necessary.

      7. Heated, freeze and chill storage space, warehouse and office space

      8. Air terminal operation to include passenger processing and cargo handling including mail bags and storage.

      9. Vehicle maintenance of USAF vehicles operated by FECO, USAF aerial refuelling unit and field maintenance for USAF vehicles and equipment except the vehicles of the Baffin Island Air Station.

      10. Ground POL service. This includes heating fuel oil, lubricants, etc

      11. Loading and off-loading of al US military cargo, to include stevedoring and transportation of cargo to and from the appropriate Frobisher and Baffin Island Air Station storgage and/or warehousing facility.

      12. Messing and housing of permanent and transient US military and permanently stationed FECO personnel beyond the capability of the USAF. Messing and housing of other transient personnel within the capabilities of DOT by local arrangement.

      13. Provide hangar space for USAF aircraft as available.

      14. Provide harbour pilotage, maintenance and control of Frobisher harbour facilities.

    3. Air Traffic Control

      When USAF operational aircraft are requried to take off to meet timed operational commitments, or other urgent military operational requirements the control tower shall afford such aircraft take-off priority consistent with the safety of other aircraft.

  6. Utilities

    1. Water, waste and garbage disposal services shall be provided by DOT exept to the Baffin Island Air Station. Sludge from the Baffin Island Air Station septic tank will be removed and disposed of once each year by DOT.

    2. DOT will be responsibility for operating and maintaining the primary and emergency back-up power distribution systems including the part located in USAF parcels of land described in Appendix I, except to the Baffin Island Air Statio.

    3. USAF may construct real property in augmentation of existing facilities as mutually agreed, in accordance with Section II.

  7. Fire and Rescue

    1. Crash and structural fire fighting and rescue will be the responsibility of DOT. Either DOT or USAF may augment aircraft crash and rescue services as necessary, including construction of facilities in accordance with Section II.

    2. Fire prevention shall be a joint effort of all agencies and services in the area.

  8. Details of Snow Removal and Control

    1. The runway will be kept serviceable for landing and take-off for aircraft at all time, for the full width and length of the runway with 100 foot safety bands on each side, if terrain permits. The runway will be considered open for landings when the width of the runway is cleared.

    2. In all other areas used for movement of aircraft on the ground, snow clearing to allow movement shall be completed as soon as possible and not later than six (6) hours after snowfall or drifting condition terminates.

    3. In case of imperative take-off or landing requirements during snow conditions the necessary priority for snow removal in any specific area will be determined by the urgency for the movement of the aircraft.

    4. All roads for utility services and personnel support shall be cleared of snow as expeditiously as possible to allow movement of vehicles.

  9. Cooperation between USAF and DOT

    1. The importance of close cooperation between DOT and USAF is recognized. It is, therefore, agreed that equipment and manpower from either agency shall be used to augment the other whenever possible to avoid disruption in any and all operations.

    2. Joint Utilization

      1. USAF shall prestock for the aerial refuelling mission all necessary supplies and equipment except when like or suitable items are available from DOT resources on the base or when DOT items will support the USAF wartime mission of the base, or, when DOT can make available to USAF in war, items which are required by DOT in peacetime only.

      2. The determinations indicated in paragraph 2(a) above, will be made by mutual agreement between the DOT agent and the local USAF commander.

      3. At the discretion of the local USAF Commander, equipment prestocked by USAF may be used by DOT. The use of such equipment shall be subject to the following conditions:

        1. DOT shall maintain the equipment

        2. The equipment shall be available for immediate support of USAF in event of an emergency.

        3. Subject to (4) below, USAF shall furnish replacement parts for pieces of equipment that have been rendered unserviceable as a result of normal wear and tear in military operation only. Where USAF equipment is utilized for commercial purposes replacement parts for equipment furnished by the USAF will be paid for udner the terms of suppplemental agreements.

        4. Where damage to the equipment is attributable to the negligence, incompetence or willful acts of members of DOT or its agents the equipment shall be replaced by USAF at the expense of DOT.

  10. Petroleum, Oil and Lubrication

    1. All remaining USAF petroleum products in place at Frobisher, except that portion located at Baffin Island Air Station, originally released to DOT for replacement in kind shall be returned to the USAF for disposal in accordance with current directives.

    2. All USAF bulk storage tanks, hydrant systems and pipelines with the exception of the storage facility at the Baffin Island Air Station shall be made available to DOT for operation and maintenance. A list of these facilities is attached as Appendix IV to the agreement. The SAC hydrant system may be used to service non-USAF aircraft when such service does not interfere with SAC requirements or security.

    3. Aviation fuel requirements established by USAF will be maintained by DOT up to the maximum capacity or USAF tankgage.

    4. All military POL product requirements shall be purchased direct from a DOT approved commercial petroleum company by the applicable US Department of Defence agency responsible for purchase of the item. Ground POL products shall be purchased on a delivered basis to USAF equipment or operating location. Aviation POL products shall be purchased on the basis of delivery into aircraft including defueling and re-service. Annual USAF POL requirements must be made known to DOT at least three months prior to the opening of navigation.

    5. DOT will include in its contract with a commercial operator provisions that quality control will be maintained in accordance with USAF standards and specifications for all petroleum products.

  11. Present equipment, supplies, vehicles

    1. USAF owned facilities, equipment, supplies, vehicles and spare parts presently located at Frobisher not required by USAF and its contractors will be disposed of in accordance with existing policy.

    2. USAF property transferred to DOT in accordance with 1. above, will compensate for and relieve USAF of responsibility for RCAF property at Frobisher turned over to the USAF in 1952.

    3. USAF property declared surplus by the US Government shall be disposed of in accordance with the exchange of notes April 11 and 18, 1951, between the Secretary of State for External Affairs and the United States Ambassador in Ottawa, concerning the disposal of excess property. (Diplomatic Note #100)

  12. Special considerations

    1. For purpose of construction, USAF will be privileged to dig, quarry and in other manner obtain rock, gravel, sand and clay within the boundaries of the airport reserve in areas, manners and amounts approved by DOT.

    2. Structures previously occupied solely by USAF which are not necessary for DOT operations and maintenance functions, and control of which now reverts to DOT will be made available to the contractors engaged in constructing the new USAF facilities.

      Upon completion of USAF construction, facilities vacated by contractor will be administered by and/or future disposition determined by DOT.

    3. When contractors or other commercial firms are employed at work for USAF, the contractor and his employees must submit to and abide by airport rules and regulations.

  13. Reinbursement

    All utilities, supplies, rations, and services provided at Frobisher Airport under this agreement, by either agency to the other agency shall be provided on a reimbursement basis except as otherwise mutually agreed. Details of accounting and financing with respect to reimbursement are attached as Appendix III Financial Arrangements. the provisions of Appendix III may be redefined annually or at such other times as mutually agreed upon between DOT and USAF.

APPENDIX II

COMMUNICATIONS

  1. CONTROL TOWER. The DOT will operate and maintain continuous control tower communication facilities.

  2. NAVIGATION AIDS

    1. Radio Range. The DOT will provide, operate and mainain continuously a simultaneous radio range service with voice facility.

    2. Non-Directional Radiobeacon. The DOT will continuously operate and maintain a LF high power radiobeacon.

    3. Instrumental Landing Aid. The USAF will provide, operate and maintain a GCA facility as required for USAF operations. The GCA will continue to operate during the airfield construction phase and the DOT will assume the cost for base support (POL for power units, maintenance of emergency power units, messing, housing, transportation, maintenance workshop and administrative space) of all USAF military personnel concerned during this period.

    4. UHF/DF. The USAF will provide, maintain and operate the UHF/DF facility as requried for USAF operations.

    5. Pilot to Forecaster. The USAF will provide, maintain and operate this facility as required for USAF operations.

    6. Tacan. The USAF will provide, maintain and operate a Tacan facility as required for USAF operations.

    7. TVOR. The USAF will provide, operate, maintain and install a temporary TVOR facility as required in support of USAF operations.

  3. AIR-GROUND COMMUNICATIONS

    1. Continuous service will be provided by DOT on normal channels.

    2. Military Air-ground. The DOT will operate continuously and maintain approved DOT, RCAF and USAF, air-ground frequencies as established by other operational documents and/or agreements.

    3. ICAO Air-Ground. Operated continuously and maintained by DOT.

  4. MONITORING. The DOT will continuously monitor the high power NDB and radio range.

  5. FIXED COMMUNICATIONS.

    1. All fixed communications except as outlined below are supplied, operated and maintained by DOT.

    2. Airops Duplex Circuit 149, (NEAC 8813) Teleprinter circuit from Frobisher to Goose. (Circuit only provided by USAF and any requested change must be co-ordinated with USAF).

    3. ATC Interphone Circuit 621. (NEAC 8812) Voice circuit from Goose ATC Center to Frobisher tower (circuit only provided by USAF and any change must be co-ordinated with USAF).

    4. Weather Duplex Circuit 260/261. (NEAC 8808). Full duplex teletype circuit from Goose Meteorological office to Frobisher Meteorological office (circuit only provided by USAF and any change must be coordinated with USAF).

    5. Weatherfax Circuit. (NEAC 6549T) Voice quality channel from Goose Meteorological office to Frobisher Meteorological office (circuit only provided by USAF and any change must be coordinated with USAF).

    6. Weather 1/2 Duplex Circuit 133. (NEAC 8886T) Teleprinter circuit from Goose Meteorological office to Frobisher Meteorological office. (This is a receive only connection to Frobisher from NEAC duplex circuit 8886T Gander Goose (DOT 131/132) (circuit only provided by USAF and any change must be coordinated with USAF).

    7. Commercial Long Distance Telephone Circuit. (NEAC 8851) Voice circuit Goose Bell Telephone Co exchange to Frobisher base general exchange. Circuit is leased to DOT by USAF for sub-lease to Bell Telephone Co. (circuit only provided by USAF and any changes must be co-ordinated with USAF.

    Note: Circuits referred to in 5.2, 5.3, 5.4, 5.5, and 5.6 are presently being operate at Frobisher by DOT. The circuit referred to in 5.7 is presently being operated at Frobisher by Bell Telephone Company of Canada. the above listed details and reference to these circuits are provided for information only. Changes will be made in accordance with other operational documents and/or agreements.

  6. LOCAL COMMUNICATIONS

    1. All local communications are supplied and maintained by the Bell Telephone Company of Canada. DOT and USAF will negotiate with that Company as required for services. Negotiations are currently underway by DOT to turn over all existing communications plant including switchboard plus related telephone instruments to that Company.

    2. Pending its replacement by an expanded and commercially owned and maintained automatic exchange, DOT has arranged for the Bell Telephone Company of Canada to operate and maintain the existing base manual exchange included its related telephones, lines, etc, as well as the base AC&W site tie cable to furnish service as required. Any increase in base cable plant and maintenance thereto required in support of the USAF mission will be provided by direct negotiations between USAF and Bell but subject to prior DOT approvals as regards siting in other than USAF designated areas.

    3. When the new USAF telephone installation is activated it will be interconnected to the existing manual exchange serving general airport requirements or to the Bell owned automatic exchange whenever the latter is established.

    4. All additional communications facilities required by USAF for military purposes only will be provided by USAF in accordance with this Agreement. Provisions of this Appendix may be re-negotiated as mutually agreed by USAF and DOT.


APPENDIX III

FINANCIAL ARRANGEMENTS

  1. EFFECTIVE DATE:

    The provisions of this Appendix are effective from July 1, 1960.

  2. USAF REQUIREMENTS FOR REIMBURSABLE SERVICES

    The following will be provided to USAF by DOT or other government agency at cost, or arranged for by DO with a commercial agency on a normal profit basis. All costs of provinding these services will be borne by USAF.

    1. Air Terminal Services as requested.

    2. Loading and off-loading of all US military cargo, to include stevedoring and transportation of cargo to and from appropriate Frobisher and Baffin Island Air Station and/or warehousing facility.

    3. Personnel, parts and supplies for maintenance of USAF vehicles in accordance with USAF technical order, manuals and regulations.

    4. Personnel for snow removal, road maintenance and garbage collection in USAF areas.

    5. Housing, messing and office space for USAF military and contract personnel in DOT areas as requested.

    6. Personnel, equipment, materials and supplies for maintenance and operation of buildings in USAF areas, except for Baffin Island Air Station.

    7. Personnel for operation of motor pool and despatching of USAF vehicles.

    8. POL ground products for buildings and vehicle operation.

    9. Personnel, materials and supplies for firefighting services.

    10. Personnel for fuelling and defuelling of USAF aircraft and other services such as deicing, etc.

    11. Purchasing of furnishings, equipment and utensils for lounge, kitchen, etc, in USAF composite area, as per requirements supplied by USAF.

    12. Laundry and dry cleaning service for USAF composite area.

    13. Messing services in the USAF composite structure complying as closely as possible with USAF menus.

    14. Clothing, messing and air fare for DOT personnel hired as a result of USAF requirements and stationed at Frobisher.

    15. DOT Administrative Personnel required for accounting, purchasing, expediating, etc.

    16. Personnel for religious services, if possible.

    17. Personnel and materials for packing and crating as requered by USAF.

    18. Purchase and maintenance of radios required in crash fire vehicles.

    19. Personnel and material to provide additional reimbursable services which may be requested by USAF and agreed to by DOT at any time during the tenure of the Working Agreement.

  3. It is agreed that a support payment of $5,000.00 per annum as defined in Annex "A" will be paid the DOT for each DOT employee or contract employee hired to provide services for the USAF and stationed at Frobisher. For all DOT or contract employees hired for USAF and living in USAF quarters DOT agrees to credit USAF at the same rate.

  4. DOT will be reimbursed for expenditures incurred for employees required to take special training before assignment to Frobisher.

  5. OPERATION AND MAINTENANCE OF POL FACILITIES

    1. The commercial operator will be responsible for the routine maintenance of the USAF owned pipelines and related facilities. A surcharge set by DOT and subject to annual adjustment will be charged by the operator on all products passing through the pipeline. The surcharge will be remitted annually to DOT and credited to a special account. All major repairs will be charged to this account.

    2. The commercial operator will be responsible for the routine maintenance of all DOT and USAF tanks. A surcharge set by DOT, and subject to annual adjustment will be collected and remitted to DOT monthly by the operator. DOT will credit the surcharges to a special account. Major repairs to the two tanks owned and used exclusively by USAF will be charged to USAF. Major repairs to all other tanks will be charged to the special account.

    3. The operator of the hydrant system will collect a surcharge for the use of the system from all users other than US military aircraft. This surcharge will be set by DOT. The surcharge collections will be remitted monthly to DOT and will be credited to a special account. The funds in this account will be turned over periodically to the USAF. The USAF will be responsible for the cost of repairs to the hydrant system.

    4. Surcharges collected for the pipeline and the DOT controlled tank services, can be used to repair either of these POL facilities. If the cost of major repairs to these POL facilities exceeds the aggregate of the two special accounts, the excess will be billed to USAF, on the understanding that USAF will be reimbursed from the special accounts when funds are available. In the case of major repairs or replacement necessistated by an Act of God or disaster, financial arrangements for such repairs or replacements will be subject to negotiation between the applicable parties.

    5. Any monies remaining in the hydrant surcharge special account and the pipeline surcharge special account at the time of winding up the agreement and after adjustments occasioned by paragraph 5.4 will be credited to USAF; any monies remaining in the tank surcharge special account at this time will be shared on an equitable basis by DOT and USAF.

  6. Subject to the availability of funds, USAF agrees to reimburse DOT for all termination costs arising out of the cancellation to a contract, purchase order or other commitment undertaken by DOT at the request of the USAF or by cancellation of the working agreement in whole or in part by the USAF. DOT agrees to use in determining such costs for presentation to the USAF the same standards and criteria that it would use in determining such costs under similar contracts for its own purposes under Canadian Law and regulation.

  7. USAF agrees that DOT is to follow its normal procurement and purchase practices for all items required for the USAF services, and that no formal acceptance of specificaitons by USAF prior to ordering or contracting is required.

  8. ADVANCE AND REIMBURSEMENT PROCEDURES

    1. USAF agrees to advance funds to DOT on approximately July 1st of each USAF fiscal year. These funds will be used to establish a special account in the accounts of the Government of Canada through which all expenditures will be paid. Expenditures paid by DOT under this agreement will be reimbursed by the USAF for deposit to this special account to replenish the initial advance except for the fiscal year settlement of this account as noted below. This advance will be one quarter of the estimated costs calculated by DOT and submitted no later than February 15th. For budget purposes dollar estimates for DOT personnel at Frobisher to meet USAF forecast requirements will be calculated at the rate of $14,500.00 per man year (See Annex "A").

    2. USAF will be billed monthly for expenditures up to and including March. Expenditures for April, May and June will be billed and charged directly to the USAF advance by DOT; no reimbursement will be made by USAF for these months.
    3. Prior to June 1st, DOT will forecast June expenditures to determine if the balance of the advance will be sufficient; if it is not sufficient an additional advance will be requested by DOT from USAF. However, if the balance of the advance is in excess of estimated June requirements, the surplus will be returned to USAF not later that the 1st of June.

    4. USAF will be reimbursed for all services provided to DOT.

    5. DOT stores items purchased for particular USAF requirements which become obsolete or surplus will be issued on a reimbursement basis to USAF.

    6. If a claim arises against DOT in accordance with Clause IX 2 (c) (4) of the Working Agreement it is agreed that in no case will DOT reimburse USAF for more than the estimated depreciated value of the equipment at the time the damage occurred.

Initial personnel to be supplied by DOT as a direct charge to USAF for the services outlined in Section "2" of Appendix III. The personnel are interchangeable as to service depending upon local conditions.
